IN RE: D.M., A MINOR
APPEAL OF: S.M., NATURAL MOTHER

No. 584 WDA 2009 2010 PA Super 86 Atlantic: n/a Filed: 5/14/2010

Appeal from the Order, March 5, 2009,
in the Court of Common Pleas of Allegheny County
Juvenile Division at No. JV-08-1251
Before: FORD ELLIOTT, P.J., SHOGAN, J. AND McEWEN, P.J.E.
Opinion by: FORD ELLIOT, P.J.
On March 5, 2009, the Court of Common Pleas of Allegheny County denied appellant, S.M., standing in a dependency disposition hearing at which a minor male child, D.M. (“Child”), was adjudicated dependent pursuant to 42 Pa.C.S.A. § 6302. Also as a part of the dispositional order, the judge ordered S.M. to comply with the Allegheny County Office of Children Youth and Families (“CYF”), obtain a drug and alcohol evaluation, and provide clean and random urine screens. S.M.’s supervised visits with Child were to remain status quo. Herein, S.M. timely appeals, asserting that, although her parental rights were previously terminated with regard to Child, she should have standing in this dependency matter as she is Child’s natural mother, Child was placed in her care and control after the termination of her parental rights, and the trial court’s order on appeal exercised control over her. Following careful review, we affirm.

L.W. (Mother) appeals from the order entered on May 4, 2009, granting the petition to terminate her parental rights to her son, L.F. (d.o.b. 5/26/01) (Child). The trial court terminated Mother’s parental rights pursuant to 23 Pa.C.S.A. § 2511(a)(1), (2), (5), (8), and (b), and changed his goal to adoption pursuant to 42 Pa.C.S.A. § 6351. Mother claims the trial court abused its discretion in compelling Mother’s therapist to testify and improperly considered her testimony in making its decision to terminate Mother’s parental rights. We affirm.

Appellant, Lycoming County Children and Youth Agency (“Agency”), appeals from the order entered in the Lycoming County Court of Common Pleas, which denied the Agency’s petition to terminate Father’s parental rights with respect to his minor child, Z.P. Upon a thorough review of the record, the arguments presented, and the applicable law, we hold the court erred in denying the termination petition. Accordingly, we reverse the order denying the Agency’s petition and remand with instructions to terminate Father’s parental rights.

Appeal from the Decree entered February 18, 2009,
in the Court of Common Pleas of Philadelphia County,
December Term No. 90016, D 7157-05-12, J 324009-03
Before: STEVENS, KELLY, and POPOVICH, JJ.
Opinion by: KELLY, J.
A.R. (Mother) appeals from the decree entered in the Philadelphia County Court of Common Pleas of Philadelphia, involuntarily terminating her parental rights to her child, K.T.E.L., born October 28, 2003. We affirm. In this case, we address an issue of first impression: the disposition of an appeal in which an appellant in a case involving termination of parental rights fails to comply with Pennsylvania Rules of Appellate Procedure 905(a)(2) and 1925(a)(2), both adopted January 13, 2009. We hold that henceforth, in all children’s fast track cases, the failure to file a concise statement of errors complained of on appeal with the notice of appeal will result in a defective notice of appeal, to be disposed of on a case by case basis.
